Man Accused of Having Relations With Dog

TACOMA, Wash. - A man accused of having sex with the family dog has been charged under the state's new animal cruelty law, which makes bestiality a felony, a prosecutor said.

Michael Patrick McPhail, 26, of nearby Spanaway, pleaded not guilty Thursday to one count of first-degree animal cruelty in Pierce County Superior Court.

Assistant Pierce County Prosecutor Karen Watson said McPhail was the first person in Pierce County to be charged with the new bestiality offense.

She said the dog was taken by animal control.

McPhail posted $20,000 bail on Friday.

Judge Katherine Stolz has set a trial date of Dec. 11.

McPhail's wife told investigators that she found her husband on their back porch Wednesday night having intercourse with their 4-year-old female pit bull terrier, the Pierce County sheriff's office report said. The dog was squealing and crying, according to charging papers.

The woman took photos with her cell phone and called the sheriff's office.

Calls to McPhail's public defender, David Katayama, were not immediately returned Friday.

The bestiality law, which took effect in June, was prompted by a case near Enumclaw in which a Seattle man died after having sex with a horse. Before the law was enacted, Washington was one of 14 states where bestiality had not been explicitly prohibited.

Sad thing is that now the poor abused girl sits in the local shelter and the wife wont take her back. :(

That poor dog ~ And you are right, Ellena; first the abuse then separated from her home.

I truly hope the wife thinks twice before she hops in bed with her husband again. G-R-O-S-S.

The dog seems very sweet but she also has a bite history (and no, the bites were not family members). They also have the dog's son impounded as well.

Why would you have sex with your dog on your porch? Assuming of course that you were interested in having sex with your dog :shock:

And while I'm sure the wife was just trying to gather proof by taking photos with her cell phone, the whole family's name is now smeared. Her poor kids are probably the laughing stock of the school yard.

I guess it's good that she got photos because that's the only way they are going to be able to prosecute this guy. Physical exam, blood work, urinanalysis, and radiographs revealed nothing that could support her other claims of abuse towards the dogs :(

Sorry I just read the link provided and that makes me want to puke as much as the violation of the poor dog.

Psado's only wants these dogs because they are high profile and will bring in donations and interest for their group. They won't normally touch Pit Bulls unless there is some big sob story behind it.

This is what annoys me SO much! I am the type of sucker that would give donations for situations like this. After getting burned one time too many, I now find try to find someone who personally knows the rescue and can vouch for them.

This leads to me giving less donations and I am probably missing out on helping a dog that truly would benefit.
