"Sovereign Immunity"

Everything that doesn't fit anywhere else!

Postby pitbullmamaliz » February 16th, 2011, 9:51 pm

So I got rear-ended today. For those who don't know, I bought my car, my very first brand-new car, in August of 2010. In October or November, somebody hit my car in the front while it was parked and failed to leave a note. Haven't been able to afford to have it fixed yet.

Today, I got rear-ended. I had stopped at a red light (novel idea, right?) and the guy behind me failed to do so. He was an IT guy for the RTA, our Regional Transit Authority (bus people). Long story short, got the run-around from the supervisor he had to call on scene, and when I called their claims department, the RTA agent told me that they have "sovereign immunity" and are only responsible for my deductible. Anything over that is billed to my insurance.

I'm sorry. What? So YOU rear-ended ME, and you expect my insurance to pay for anything over my deductible? Doesn't that punish me?

So we'll see about that. I filed a police report and the police officer said that was the stupidest thing she's ever heard and it's illegal. RTA requires two estimates to repair my car, so I'll get those and then let the games begin. I DARE them to try to charge my insurance. I almost hope my estimate is over my deductible so I can fight this and cause a scene.

But how ridiculous is that???

Bring your car to two dealers for the repair estimates.

Oh absolutely. I'm taking it first to the dealership where I bought it, and then I'll ask around and see which other Honda dealerships charge way too much for repairs. :D

I didn't. He was literally going about 5 miles an hour. The only damage to my car is about an inch-long scratch, but I think it's deep enough it can't be buffed out.

I was in my Mom's older car and at a light I got hit. Nothing big. Ladies insurance company gave me $800! I even told them if they sent me the right colored magic markers, I could cover the tiny scratch. 8)

Our insurance paid this type of claim under the uninsured/under-insured portion of our policy (no deductible).

Bob, after it happened I called my agent and he said that if I claimed it my rates would go up. :(

Sounds like car insurance in Ohio is bullshit. I adore my insurance company. For my accidents they have fought the other insurance companies HARD and my cars have been fixed (or reimbursed and THEN SOME in one case) plus all of my medical has been covered. If it wasn't your fault you insurance company should be FIGHTING for your right and not just saying "Oh well. Sucks to be you." Time to find a new car insurance company if that's how they feel . . .

I don't know who you insure with but I would be looking around.
We use the 'lizard' with $1000 deductible on comp/collision and $1,000,000 'umbrella' on the rest for less than $900 per year.

I'm with Farmers and I adore them and my agent. I won't switch - I have my homeowners through them and they're one of the few that will insure me with Inara in the house.

And my insurance guy didn't say my rates would go up from being rear-ended yesterday, they would go up if I had them fix my hit/run damage. I've only been with them since August so I don't have a history built up with them.

Ditto-- only asked me if a dog in the home had a bite history.

I hit ice on the interstate, going too fast (and was cited for that), totaled the car-- it was a 6 year old beetle with 85k miles on it, and I got an $8000 check (only a $500 deductible).

After a hail storm, 1 month after moving into the house, we got a $25k settlement and they said we can do most of the work ourselves. I also love my agent-- she answers my emails immediately. I pay a little more, but they have been DAMN good to me.

State Farm was crazy expensive and I had more than one agent tell me they won't cover pit bulls. I told they they were wrong, but I'm not going to try to convince somebody to let me give them my money. So I'm sticking with Farmers.
