"FALL RIVER -- A resolution sponsored by three city councilors would regulate the existence of pit bulls and Rottweilers in the city.

The ordinance, as proposed by Council President William F. Whitty and councilors Patricia Casey and Thomas Kozak, is being established "because of the perceived and demonstrated danger to life, health and safety of humans and animals posed by so-called pit bull dogs and Rottweilers."


As required through the ordinance, pit bull and Rottweiler owners would be required to keep their dogs on their property by constructing a fence at least 6 feet high. When the dogs are outside, the ordinance will also require that the dogs are confined in a securely enclosed and locked pen or structure that would prevent young children from entering and the dogs from escaping.

The dogs would only be allowed off the owner’s property in instances that require medical or veterinary care or to transport the dog permanently out of the city limits. In any of those instances, the dogs must be securely muzzled and leashed.

The ordinance would also make the sale or facilitation of the sale of either breed prohibited within the city.

Whitty said the council began looking at establishing such an ordinance over the winter after hearing of a number of instances of attacks regarding the two breeds last fall. After hearing of varied problems, Whitty said he contacted members of the Police Department to help craft the ordinance.

"We looked at and researched other ordinances in towns and cities, as far away as Miami and locally, and the fact that cities and towns in the area are enacting these ordinances warrants our doing this," Whitty said. "These two breeds are different than others. They’re known as killer canines, they don’t bite, they kill and maim, so we wanted to come up with something that is strict, tough and very enforceable."

Any person who violates any provision of the ordinance or fails to register their pit bull or Rottweiler as required by law would be subject to a fine of $250 per offense and possible disposal of the animal.

The resolution will go before the City Council tonight with a vote expected to take place on sending the matter to the council’s Committee on Ordinances and Legislation. Whitty said City Corporation Counsel Thomas McGuire is expected to sit in with the committee to help form the final ordinance.

Whitty said while in committee a few tweaks may be made, including provisions requiring pit bull and Rottweiler owners to post signs altering people to the dogs’ presence and requiring dog owners who rent property to have the property owner’s signature before the dog can be registered. "

Last I checked, dogs without proper exercise (AKA walks) are more prone to aggression. That seems counter-productive, and quite frankly, cruel.

I think a local rescue just got in a pit mix abuse case from Fall River. Maybe they should focus on THAT instead!

And not letting the dogs off of the property. GREAT IDEA! Let's not socialize them so that that way, when they have to be taken to the vet or someplace else, they are raving lunatics. AWESOME!
