Appeal filed in fight over pit bull ban

A ruling by U.S. District Judge Walker Miller dismissing a challenge to Denver's pit bull ban has been appealed to the 10th U.S. Circuit Court of Appeals in Denver.

In the appeal, attorneys for the American Kennel Club, acting on behalf of former Denver resident Sonya Dias, claim that the Denver ordinance, enacted almost two decades ago, is based on a stereotype — that if a dog is a so-called pit bull, or even resembles a pit bull in some physical respects, it must be vicious and dangerous.

"Like almost all stereotypes, this one is false," said the appeal.

The attorneys, including Karen Breslin of Lakewood, claim that the aggressiveness of a dog toward humans or other animals is principally a product of training and upbringing and not breeding.
